FFLGuard announced that its client, Brink's Incorporated ("Brink's"), has voluntarily dropped its appeal of the revocation by Bureau of Alcohol, Tobacco and Firearms ("ATF") of Brink's Federal Firearms License ("FFL") for its Coppell, TX headquarters. This termination of litigation comes contemporaneously with ATF's issuance of four (4) new FFLs to Brink's, including a brand new one for the Coppell, TX location. These new licenses came as part of FFLGuard's intervention into a dispute between the 150 year old company and ATF regarding compliance issues.
Brink's original FFL in Coppell, TX, which was initially issued by ATF in 2001, came into the public spotlight when the ATF Director of Industry Operations from Dallas, Texas, revoked the FFL in 2012, following four (4) previous ATF inspections over the prior decade that did not trigger any administrative action by ATF whatsoever. FFLGuard aided Brink's in the litigation and high-level discussions necessary to correct questionable actions by ATF in the field.
"This unprecedented move - the termination of one FFL in return for the issuance of four new FFLs -- concludes over a year's worth of work by FFLGuard, on behalf of Brink's, to replace an FFL in Coppell, Texas that probably should never have been revoked", stated Christopher Chiafullo, National Coordinating Counsel for FFLGuard. "We are very pleased that ATF Senior Executives in Washington, DC saw fit to rectify this issue properly... [i]t's a testament to their new leadership to make a course correction when appropriate."
"With FFLGuard's expertise, hard work, and advocacy on our behalf, we were able to resolve this unenviable situation with great success," stated Dennis Casteel, Director of Firearms Control for Brink's. "Having FFLGuard in our corner made all the difference in the world."
