Knife Rights and its fellow plaintiffs have filed a Notice of Appeal in our Federal Second Amendment lawsuit against the Federal Switchblade Act.
Knife Rights Founder and Chairman Doug Ritter said, "this is the first procedural step needed to get the appeal going at the Fifth Circuit Court of Appeals. We remain optimistic that a three-judge panel will reverse the utterly irrational District Court ruling in our case."
A recent development in another Fifth Circuit case may prove helpful to our appeal. The Fifth Circuit Court of Appeals has withdrawn a badly flawed and irrational three-judge panel opinion involving similar Second Amendment issues to our case in United States v. George Peterson. Moreover, the Department of Justice recently submitted an Amicus (friend-of-the-court) Brief in support of Appellants in a Second Amendment lawsuit challenging the Illinois Protect Illinois Communities Act (PICA), which bans so-called “assault weapons” and “high-capacity magazines”, all constitutionally protected arms. The DOJ brief urged the Seventh Circuit to uphold Appellants' 2A victory at the district court. Certain statements in the Amicus Brief support Plaintiff's position in our own lawsuit.
